Introduction
The website https://www.annickgoutal.com/ (the “Website”) is an e-commerce site accessible via the Internet and open to any and all users thereof. It is published by Interparfums (the “Company”):
Interparfums is a French corporation (Société Anonyme) with capital of €251,183,547, registered with the Paris Trade and Companies Register under number 350 219 382, having its head office at 10 Rue de Solferino 75007 Paris, France, and with Intra-Community VAT number FR 39 350 219 382 and Extended Producer Responsibility (EPR) Identification Number – Household packaging – CITEO Eco-organization: FR209179_01QIOV.
1. SCOPE OF APPLICATION
1.1 These general terms and conditions of sale (the “GTCs”) apply to the sale of products bearing the Company’s Annick Goutal trademarks (the “Product(s)”), via the Website, in the following countries: Austria, Belgium, Croatia, Estonia, Finland, France, Germany, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, the Netherlands, Portugal, Slovakia, Slovenia, Switzerland (the “Territory”).
1.2 To purchase Products on the Website, customers (the “Customer”) must have the legal capacity to place an order and do so as consumers (i.e., any natural person acting for purposes independent from his/her trade, business, craft, or profession).
1.3 By checking the corresponding box on the Website during the order process, the Customer acknowledges having read, understood, and accepted these GTCs without restriction or reservation. The Customer may save or print these GTCs (provided that no modification is made thereto), which are also permanently available on the Website.
1.4 These GTCs may be modified or updated by the Company at any time. However, the GTCs applicable to a specific order are those accepted by the Customer upon placement of the order.
1.5 These GTCs are drafted in French. The French wording is the sole authentic version and shall prevail over any other version in the event of a contradiction.
1.6 In accordance with applicable legal provisions, it is hereby reiterated that the validation of an order as specified in these GTCs constitutes an electronic contract between the Company and the Customer, serving as proof between the parties of the entirety of the order and the payability of the amounts due in execution thereof.
2. PRODUCTS AND PRICES
2.1 The Products sold by the Company via the Website are perfumery and cosmetic products, the essential characteristics and prices of which are available on the Website, in accordance with applicable legal provisions.
2.2 The prices of the Products are indicated on the Website in euros, inclusive of all taxes. They include VAT as applicable on the date of the order. Any change in the applicable VAT rate will be reflected in the prices of the Products.
2.3 The price of the Products sold on the Website is indicated for each item and reference. The Company reserves the right to modify its prices without notice. The prices to be paid by the Customer are those displayed on the Website at the time of the order.
2.4 Products are offered subject to availability. If the Products ordered are not available, the Company shall immediately so inform the Customer by any appropriate means (telephone or email) and shall refund the amounts paid in respect of the order within fourteen (14) days from the date on which the Customer was informed of the unavailability of the Products.
2.5 While the Company takes all reasonable professional measures to ensure, to the extent permitted by applicable law, the accuracy of all details, descriptions, and images of Products displayed on the Website at the time such information is entered into the system, the Company does not guarantee that such Product details, descriptions, and images are absolutely precise, complete, reliable, up-to-date, and error-free. It is further specified that Product visuals are presented for information purposes only and have no contractual value, to the extent permitted by applicable law.
2.6 The Products described on the Website, as well as any samples that the Company may provide at the Customer’s request, are intended for personal use only. The Customer agrees not to use the Products for commercial purposes or resale. If the Customer has not received one or more requested samples, the Company will not be able to send the Customer the sample(s) in question.
3. ORDERING
3.1 The Customer may browse the Website with no obligation to purchase.
3.2 The Products offered on the Website are intended for end consumers with a delivery address located in the Territory.
3.3 The Company reserves the right to limit the quantity of Products that may be purchased by a Customer, in accordance with applicable legal provisions. In this context, the Company does not sell to an individual Customer more than five (5) specimens of the same item and reference; should the Customer order more than said quantity in a single order or a series of orders, the Company reserves the right to request proof from the Customer of his/her status as a consumer and may refuse the order, as appropriate.
The Company reserves the right to refuse an order placed by a Customer with whom a dispute exists regarding a previous order, or in cases where the Company reasonably believes that said Customer has violated the GTCs or engaged in fraudulent activity, or for any other legitimate reason.
3.4 The ordering process is as follows:
· Product Selection: The Customer must select the Product(s) he/she wishes to order and indicate the desired quantity.
o The Customer places the Product(s) in his/her shopping cart by selecting the desired item and then clicking on the price icon.
o The Customer may choose to continue shopping and add other products to his/her shopping cart, or proceed to checkout by clicking on “ADD TO CART”.
o At any time during the shopping process, the Customer may verify the Products in his/her shopping cart by clicking on the shopping cart icon. The Customer may remove Products from his/her shopping cart by clicking on the relevant icon next to the selected Product in the shopping cart. The Customer may also modify Product quantities or add Products.
o In the event of prolonged inactivity during the session, availability of the Product(s) selected by the Customer prior to said inactivity may no longer be guaranteed.
o The availability of the Products contained in the shopping cart is subject to change, and the Customer is bound by the availability and final price applicable at the time the “CHECKOUT” option is selected.
· Placement of an order by the Customer:
o The Customer completes the required “CONTACT”, “DELIVERY METHOD” and “SHIPPING ADDRESS” information and then clicks on “CONTINUE TO SHIPPING.” The Customer undertakes to ensure that all information provided to the Company via the Website in connection with the order complies with these GTCs and is accurate and up to date, failing which the Company reserves the right to cancel the order and the corresponding payment. The Company assumes no responsibility for the consequences of inaccurate information provided by the Customer.
o The Customer selects a “SHIPPING METHOD” in accordance with the terms of Article 7 of these GTCs, and then clicks on “CONTINUE TO PAYMENT”.
o The Customer completes the “PAYMENT” information in accordance with the terms of Article 5 of these GTCs, as well as the “BILLING ADRESS” information, and then clicks on “REVIEW ORDER.”
o The Customer reviews the summary of his/her order, which includes the description of the Product(s), the price per Product, and the total price payable. The Customer may return to a previous page, as necessary, to change any information provided. The Customer must ensure that all information accurately reflects his/her wishes concerning the order.
o Prior to confirming the order, the Customer certifies having read these GTCs and accepts them without reservation by checking the relevant box on the Website.
o Order completion: Once all the information has been verified and confirmed, the Customer may finalize the order for Products on the Website by clicking on the “PAY NOW” button.
· Order Confirmation: Once the order has been submitted, a confirmation page is displayed and the Customer receives an email confirming receipt of the order.
· Order Tracking: The Customer will receive information by email regarding the various stages of order processing and preparation up to the shipment of the Products ordered. A carrier tracking number will be provided to the Customer upon confirmation of the order. Customers wishing to obtain information regarding the tracking of their order may log on to the carrier’s website and track the delivery of the package in real time.
3.5 For any questions or problems concerning an order, the Customer may contact the Company’s Customer Service Department via the contact form on the Website, available at the following address: https://www.annickgoutal.com/.
3.6 The Company retains ownership of the Products ordered until full payment of the price and any additional charges has been received. In the event of a payment incident, the Customer undertakes to return the Products received to the Company, at his/her own expense, upon initial request.
4.1 Customers ordering a “DISCOVERY SET” will receive a personal promotional code to be used on their next purchase of a perfume, entitling the Customer to a discount equal to the purchase price of said DISCOVERY SET, applicable to a subsequent perfume purchase made on the Site.
The Customer must enter the promotional code in the box provided upon placing his/her order on the Website.
The promotional code may be used once only, is not cumulative with any other promotional offer, and shall not give rise to any refund, exchange or carry‑over if the amount of the order is lower than the amount of the discount granted.
4.2 The Company offers a promotional “BIRTHDAY” offer enabling the Customer to benefit from a 10% discount on the total amount of their Order during their birthday month, provided that the Customer has entered their date of birth in their customer account or upon placing its order. This discount is granted through a personal promotional code sent to the Customer, which may be used only during the calendar month of their birthday on any Order placed on the Website. The Customer must enter this code in the designated field at the time of placing the Order on the Website. The promotional code may also be used in the Company’s stores located in Paris (Bellechasse and Saint-Sulpice), upon presentation of the corresponding birthday email and subject to compliance with the conditions set out in this Article. The birthday promotional code is valid for a single use only, may not be combined with any other promotional offer, and may not give rise to any refund, exchange, or reissue in the event of non-use. The Company reserves the right to refuse or cancel any use of the promotional code in the event of fraudulent use, in particular in the case of the creation of multiple customer accounts.
5. PAYMENT
5.1 The Customer must follow the instructions of the online payment server to complete payment.
5.2 The Customer may pay for the Products by credit/debit card, PayPal, Apple Pay or by the local payment methods listed in the table below, in accordance with the terms and conditions of said applications. The Customer is deemed to have accepted the general terms and conditions of sale and the privacy policy of the payment application selected.
The following credit/debit cards are accepted on the Website: Carte Bleue, Visa, American Express, Master Card.
The transaction is debited from the Customer’s credit/debit card following verification of the card details and receipt of debit authorization from the issuer of the credit/debit card used by the Customer. In the event that the issuer of the credit/debit card refuses to authorize the payment, the Order shall not be validated.
It is specified that certain payment methods (hereinafter referred to as the “Local Payment Methods”) are available only depending on the Customer’s country, the eligibility conditions defined by the payment service providers and, where applicable, the compatibility of the device used.

Klarna The Customer may use their Klarna account to pay for their Orders on the Website in instalments. This service is provided by Klarna, an independent payment provider. The option to pay in three (3) instalments offered by Klarna is governed by the terms and conditions set out in Klarna’s Terms and Conditions available by clicking here. Its use is subject to the Customer’s eligibility as determined by Klarna.

5.3 Credit/debit card holders may be subject to validation checks and authorization by the card issuer. In the event of refusal or non-authorization of payment by the card issuer, for any reason, either prior or subsequent to payment, the Company assumes no responsibility for any resulting delay or failure to deliver.
5.4 In accordance with applicable legal provisions, the commitment to pay by means of a credit/debit card is irrevocable. By providing his/her credit/debit card details, the Customer authorizes the Company to debit the card in question for the amount corresponding to the price of the Products purchased, without prejudice to the Customer’s right of withdrawal and the rights to reimbursement provided for by applicable law and these Terms and Conditions.
5.5 Payments for purchases made on the Website are processed through the Shopify Payments solution.
In the event of payment by credit card, the Customer shall provide the card verification value (CVV) appearing on the credit card.
As part of fraud prevention and payment security measures, information relating to the Order may be transmitted to the payment service providers designated by the Company or to any third party authorized by law, solely for the purposes of verifying the Customer’s identity, validating the payment, preventing fraud, and complying with applicable legal and regulatory obligations.
The Company reserves the right to suspend or cancel any Order in the event of suspected fraud or unauthorized payment.
The Company takes all appropriate technical and organizational measures to ensure the confidentiality and security of data transmitted on the Website.
6. ORDER PROCESSING
6.1 The Customer may check the status of orders by going to the “ORDERS” page of his/her customer account on the Website. The Customer logs into his/her customer account using the email address associated therewith and entering the code received by email at said address.
6.2 Orders may be canceled in whole or in part by the Company’s systems for various reasons, including: Product(s) unavailable (even though the Company makes every effort to ensure that unavailable items are displayed as such on the Website), inability to process payment information, inability to deliver to the address provided upon placement of the Order, cancellation at the request of the Customer. In the event of cancellation, the Customer will receive an email explaining the reason for the cancellation. The Customer shall not be billed for canceled orders. 7. DELIVERY
7.1 The Customer chooses one of the delivery methods offered on the Website upon placing the order, including delivery to the Customer’s address, to a pick-up point, or delivery to a store where this option is available (under the conditions set out in Article 7.2). Delivery shall be made to the delivery address specified by the Customer. The address provided by the Customer must be located within the Territory, failing which the order will be refused. The Customer bears sole responsibility for any failure to deliver due to a lack of information provided upon placing the order.
7.2 In-store delivery (Click and Collect): The Click and Collect option is offered at the time of selecting the delivery method only for Products deemed available in the store selected by the Customer. The Customer is informed by email when the Product(s) are available for collection in the store. However, in the event of exceptional unavailability of one or more Product(s) after the Order has been placed, the Order shall be cancelled in accordance with Article 6.2 of the Terms and Conditions, and the Customer shall be informed by email. The Order will be made available in the store within an indicative period of 24 working hours from its confirmation, in accordance with the store's opening hours. The Customer shall have a period of 15 days from the notification of availability by email to collect their Order in-store. After this period, the Order may be cancelled under the conditions set out in the Terms and Conditions. Collection of the Order requires the presentation of a valid form of identification and the order number. The Customer may appoint a third party to collect the Order, provided that such person presents their own identification, the Customer’s identification, and the order number. Any anomaly or reservation identified must be reported in store.
7.3 Orders are generally processed within one (1) business day. An order must be fully processed before the Products can be shipped.
7.4 The delivery date depends on inventory availability, the processing date, the order shipping date, and the shipping time associated with the delivery method. Orders are generally delivered within the following timeframes (provided for reference only):
· Delivery by MONDIAL RELAY: 2 to 4 business days
· Delivery by CHRONOPOST France: 1 to 2 business days
· Delivery by CHRONOPOST European Union: 1 to 5 business days
· Delivery by COLISSIMO INTERNATIONAL (for Switzerland) : 3 to 4 business days
For information about delivery, the Customer may log into his/her account in accordance with Article 6.1 of these GTCs, or contact the Company via the contact form on the Website, available at the following address :https://www.annickgoutal.com/.
During peak periods, product launches or other major events, the processing time for requests may be longer. It is specified that shipping and delivery times may be subject to delays in the event of unavailability of the Products ordered, public holidays, carrier strikes, surges in orders, or in cases of force majeure.
However, in accordance with applicable legal provisions, the Product will be delivered no later than thirty (30) days after the Order has been confirmed.
7.5 Orders are shipped on business days only.
7.6 Delivery is free of charge.
7.7 For orders exceeding a certain volume of Products, or should one of the Products making up the order be unavailable, the Company reserves the right to ship the Products to the Customer in several deliveries and/or several packages at no additional charge.
7.8 Deliveries are deemed to have been completed once the Product(s) are made available by the carrier to the Customer or to a third party designated by the Customer, or, in the case of in-store delivery, as soon as the Customer collects the Product(s) from the selected store. The Customer is responsible for verifying the conformity and completeness of the Product(s) immediately upon receipt.
7.9 Any anomaly/reservation identified at the time of delivery (in particular late delivery, missing or damaged products) must be reported by the Customer to the carrier:
- For MONDIAL RELAY deliveries: within 15 calendar days of pickup of the package,
- For CHRONOPOST deliveries: within 14 days following the order delivery date (21 days for international shipments) under the conditions provided for by the carrier.
- For COLISSIMO INTERNATIONAL deliveries: as soon as possible following delivery,
in accordance with the carrier’s applicable terms and conditions.
Any reservations must also be notified as soon as possible to the Company’s Customer Service Department via the contact form available on the Website, at the following address: https://www.annickgoutal.com/. A copy of the complaint sent to the Carrier must be attached.
7.10 Delayed Delivery: In the event of a delay in delivery (exceeding the maximum delivery time of thirty (30) days following confirmation of the order), the Customer must report said delay as soon as possible via the contact form on the Website, available at the following address: https://www.annickgoutal.com/. The Customer may choose to cancel the order by sending a notice of cancellation. The Customer will receive a refund of any amounts debited within fourteen (14) days of receipt of said notice of cancellation.
8. RIGHT OF WITHDRAWAL
8.1 The Customer is entitled to withdraw the order, with no obligation to explain said withdrawal or pay penalties. The withdrawal period expires fourteen (14) business days after the day on which the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the Products. If this period expires on a Saturday, Sunday, or public holiday, it is extended to the next working day. The Company will reimburse the Customer the amount paid for the purchase of the Product(s) in full, including delivery costs, without undue delay and no later than fourteen (14) days from the date on which it is informed of the Customer’s decision to withdraw.
8.2 If the Customer has ordered several Products in a single order, or if the Products have been delivered in several shipments, the withdrawal period shall not begin until the Customer has taken physical possession of the last Product or the last shipment making up the delivery.
8.3 To exercise the right of withdrawal, the Customer must inform the Company of his/her wish to exercise said right prior to the expiry of the withdrawal period.
8.4 The right of withdrawal cannot be exercised for Products that have been opened by the Customer following delivery (the protective film must be intact) and that cannot be returned for reasons of hygiene or health protection.
8.5 The Customer may exercise the right of withdrawal either via the online returns management service provided by the Company and available at the following address https://app.fastoche.co/app?shop=annick-goutal-paris&view=home&return=, or by completing and sending the withdrawal form template provided in Appendix 1 by mail to the following address: INTERPARFUMS / ANNICK GOUTAL Customer Service / 10 Rue de Solférino / 75007 PARIS / FRANCE. The Company will send the Customer an acknowledgment of receipt of the withdrawal by email.
The Customer must affix to the return package the return label printed from the Website or sent by the Company or made available via the online returns management service.
8.6 For Orders collected in store under the Click and Collect service, the Customer may, if they so wish, exercise their right of withdrawal by returning the Products directly to the store from which the Product(s) were collected. In such case, the Customer must present the order number or any element allowing the identification of the Order. All other conditions for exercising the right of withdrawal are governed by the provisions of this Article 8.
8.7 Following notification of the decision to exercise the right of withdrawal, the Customer must return the complete, unused Products to the Company in their original packaging, intact and, to the extent possible, accompanied by all original packaging accessories, within a maximum of fourteen (14) days following notification by the Customer of the decision to withdraw. The Company reserves the right to postpone the refund until it has received the Products back or until the Customer has provided proof of shipment thereof, whichever occurs first. If the Customer cancels his/her order without returning the Products within the aforementioned period, the Company will not be obliged to provide a refund.
9. WARRANTY
9.1 The Company undertakes to deliver Products in conformity with the Customer’s order.
Products sold by the Company are subject to the legal warranty conditions provided for in Articles L.217-3 to L.217-20 of the French Consumer Code (legal guarantee of conformity) and Articles 1641 to 1648 of the French Civil Code (legal guarantee against hidden defects), summarized in broad terms in this article. Damage resulting exclusively from modification, repair, integration, or addition by the Customer is excluded from the warranty. These warranties shall only apply pursuant to a claim by the Customer, submitted in the prescribed form and within the time limits specified in this article; the Customer is solely responsible for proving that the warranty conditions are met.

9.2 Legal guarantee of conformity: The Customer has a period of two years from the date of delivery of the Product to take action in the event of a lack of conformity (unsuitability for the generally expected purpose of similar goods, inconsistency with the description provided by the Company or absence of the qualities advertised by the Company or agreed between the Parties). The Customer may choose between repair or replacement of the Product, subject to the cost conditions set out in Article L.217-12 of the French Consumer Code. The Customer is not required to provide proof of the existence of the non-conformity throughout the duration of the legal warranty. If repair or replacement of the Product is not possible, the Company may refund the price of the Product in part or in full.
9.3 Warranty against hidden defects: The Customer has a period of two years from the discovery of the defect to take action. Under the conditions provided for in Article 1644 of the French Civil Code, the Customer may choose between returning the Product and receiving a full refund, or keeping the Product and receiving a partial refund.
10. INTELLECTUAL PROPERTY
The Website and all content published thereon (including trademarks, text, models, images, videos, and music) are protected by intellectual property rights. Such items are the exclusive property of the Company and its contributors, and no license or right is granted other than that of consulting the Website. All trademarks referenced on this Website enjoy legal protections as trademarks registered on behalf of their respective owners.
Reproduction or representation of the Website and its content, in whole or in part, as well as the use thereof for purposes other than those provided for in the terms of use, are prohibited absent prior authorization from the Company. Failure to comply with this prohibition constitutes an act of infringement for which the offender shall be held liable.
11. PERSONAL DATA
11.1 The provisions relating to personal data transmitted between the Company and the Customer, within the framework of the execution of the GTCs, are set out in the personal data processing policy available at the following address: https://www.annickgoutal.com/en/policies/privacy-policy.
12. MISCELLANEOUS PROVISIONS
12.1 Force majeure: The Company shall not be liable for any failure to perform its obligations under these GTCs, in whole or in part, if such failure results from an event constituting force majeure. Events fulfilling the criteria set out in the applicable legal provisions and case law at the time of the occurrence of the event in question shall be considered as force majeure. The Company shall inform the Customer of any such event no later than thirty (30) days after occurrence. If the suspension of the Company’s performance of its obligations continues for more than thirty (30) days, the Customer or the Company may cancel any order affected by this delay by so notifying the other party. In this case, the Customer shall be reimbursed within fourteen (14) days of notification.
12.2 Partial invalidity: Should one or more provisions of these GTCs be declared null and void in whole or in part, the other provisions shall remain unchanged and applicable.
12.3 Entirety of the GTCs: These GTCs and the order summary sent to the Customer form a contractual whole and constitute the entirety of the contractual relations between the Customer and the Company. In the event of any contradiction between these documents, the GTCs shall prevail.
13. APPLICABLE LAW AND JURISDICTION
13.1 These GTCs are governed by and must be interpreted in accordance with French law.
13.2 Any dispute arising from the formation, interpretation, or performance of these GTCs shall be submitted to the competent French courts or any other competent judicial authority.

13.4 In the event that a written complaint goes unresolved, the Customer may, in accordance with applicable legal provisions, resort to a conventional mediation procedure or any other alternative dispute resolution procedure.
